Observatory on European Studies

The Observatory on European Studies (ISBN 978-65-86439-56-4) is a dynamic and democratic space for communication on current issues and news concerning European integration in its most different facets and, mainly, its impacts and relations with Latin America.

The Observatory prioritizes the publication of news, insights related to European legal and political events and brief comments on European case law that generate interest to the international community. It also seeks to stimulate the dissemination of experiences and good practices in the area of regional and European integration, as an important tool for developing the concepts of international legal and political cooperation.

To submit a publication to the Observatory on European Studies, the author must follow the rules contained in the Submissions page and in the Guidelines for Authors. The publication will be analyzed by the Editorial Board and the decision will be communicated to the author.

    DEADLINE EXTENDED - Call for Papers

    The deadline to submit scientific papers to the Workshop event of the II Jean Monnet Network Seminar on “Migration and Citizenship in the European Union and Latin America”, has been extended until the 22 October 2021.

    The event will be held virtually on the 9 November 2021, hosted by the Federal University of Santa Catarina (Brazil).

    Due to the deadline extension, the Organizing Committee will communicate to authors by e-mail about the results of the submissions by 27 October 2021.

    The selected articles will be invited to publish in the Latin American Journal of European Studies or in the Collection of the Workshop.  The top two articles will also receive an award of EUR 250 each.

    VIRTUAL TRAINING COURSE - CLOSED REGISTRATION

    The registration for the training course called “The process of regional integration in the European Union and its impact on the provision of legal assistance in Latin America” was closed today, since were filled the 150 vacancies available.

    The training course has been organizing by the Jean Monnet Network - BRIDGE Project, co-funded by the Erasmus+ Programme of the European Union, the Latin-American Center for European Studies - LACES, in partnership with the Escola Nacional da Defensoria Pública da União – ENADPU (Brazil).

    VIRTUAL TRAINING COURSE OPEN FOR REGISTRATION - JEAN MONNET BRIDGE

    The Project Jean Monnet Network - BRIDGE, co-funded by the Erasmus+ Programme of the European Union, the Latin-American Center for European Studies - LACES, in partnership with the Escola Nacional da Defensoria Pública da União – ENADPU (Brazil), the entire academic community and other interested parties to participate in the training course “The European Union's regional integration process and its impact on the provision of legal assistance in Latin America”.

    The objective of the course is to examine the legislation and policies of the European Union in order to understand how this process of regional integration deals with complex legal issues that impact the provision of legal assistance offered in Latin American countries. Particularly, it is intended to identify the policies and legal instruments available to facilitate judicial cooperation and build new bridges of dialogue between the European Union and third countries, in particular, Latin American ones.

    The course will be taught virtually on the ENADPU platform with live classes on October 6th, 8th, 13th, 14th, 18th, 20th and 22nd, always from 10am to 12pm (Brasilia time). Subjects will be taught in Portuguese or Spanish.

    Com um acórdão adotado em 22 de junho no âmbito do processo República Bolivariana da Venezuela c. Conselho da União Europeia, Processo C-872/19 P, a Grande Seção do Tribunal de Justiça da União Europeia (TJUE) propôs uma leitura inédita do art. 263, parágrafo quarto, do Tratado sobre o Funcionamento da União Europeia (TFUE), que disciplina os critérios de admissibilidade do Recurso de anulação contra atos das instituições europeias.     Nuno Cunha Rodrigues, a partner of the BRIDGE Project, recently published the text entitled “The FO v Ministère public (Sanctions extraterritoriales) case: revisiting the territoriality principle” in which the author comments on the recent judgment of the Court of Justice of the European Union “Ministère public (Sanctions extraterritoriales) (C- 906/19)” in the well-known blog EUlawlive.

    According to the author the judgement is “a preliminary ruling concerning the possibility and limits for the imposition by a Member State of sanctions for road transport infringements in other Member States.”

    The Annals of the I Seminar Jean Monnet Network BRIDGE about “Commercial and investment relations between the European Union and Latin America” are now available

    The collection of assignments presented here is the result of the I Workshop Jean Monnet Network – BRIDGE on “Commercial and investment relations between the European Union and Latin America” which took place on March 15, 2021, in virtual mode, at the European Institute of the Faculty of Law of the University of Lisbon. This initiative promoted an intense debate on the theoretical and practical aspects of partnerships between the European Union and Latin American countries in the sector of international trade and foreign investment, with the presence of professors and researchers from several universities.

    The proceedings are part of the activities developed by the Cátedra Jean Monnet coordinated by Professor Nuno Cunha Rodrigues and by the Jean Monnet Network project called “Building Rights and Developing Knowledge between the European Union and Latin America – BRIDGE”, co-financed by the Erasmus+ Program of European Commission (620744-EPP-1-2020-1-BR-EPPJMO-NETWORK), coordinated by Professor Aline Beltrame de Moura.

    The articles presented at the Workshop were previously evaluated through Call for Papers, launched in November 2020, and selected by the Organizing Committee composed of Professors Nuno Cunha Rodrigues (University of Lisbon), Elizabeth Accioly (European University of Lisbon) and Aline Beltrame de Moura (Federal University of Santa Catarina). Part of the articles selected for presentation at the Workshop were published in Anais do I Seminário Jean Monnet Network BRIDGE (PDF archive) and the others in the I edition of the Latin American Journal of European Studies (2021-1).

    Result: I Contest “Monograph Contest for Young Latin American Researches – Jean Monnet Award"

    The organizing committee of the “I Monograph Contest For Young Latin American Researchers – Jean Monnet Award", an initiative of the Jean Monnet Network project “Building RIghts and Developing Knowledge between the European Union and Latin America – BRIDGE Project”, co-financed by the Erasmus+ Program of the European Union, and the Latin American Center for European Studies is honored to announce the result of the first edition of this competition.

    Marcelo Terra Bento Martinelli, an undergraduate student in International Relations at the Federal University of Uberlândia, was the winner of this edition of the competition. Author of the monograph entitled O PACTO ECOLÓGICO EUROPEU E SEUS EFEITOS SOBRE A COMUNIDADE INTERNACIONAL, Marcelo will receive the equivalent prize of 1,000.00 (one thousand) Euros for being the best classified among the contestants, the paper will be published in the form of an article in the journal “Latin American Journal of European Studies”.

    The Honorable Mention was won by Victor Matheus de Santana Santos, Master's student in Political Science at the Federal University of Pernambuco, with the monograph AS ELEIÇÕES DE 2014 PARA O PARLAMENTO EUROPEU: O CRESCIMENTO DA DIREITA EUROCÉTICA E O DEBATE SOBRE “ELEIÇÕES DE SEGUNDA-  ORDEM” the paper also will be published in the journal “Latin American Journal of European Studies”.

    The main purpose of the Journal is to publish research related to the European Union Law and Policies and International Relations of the European Union with third countries and Latin America to create new knowledge, build bridges of dialogue, as well as exchange good practices between European Union and Latin America. 

    The second issue of the Journal is open to submission until November 1st, 2021 and contains a thematic dossier on Migration and Citizenship in the EU and Latin America.

    On May 23 of 2021, Roman Protasevich, a journalist and well-known critic of Lukashenko’s regime and his girlfriend Sofía Sapega, a law student, were traveling from Athens, Greece to Vilnius, Lithuania. Suddenly, their plans changed. Two KGB members that were on board allegedly reported ‘a bomb’ and forced the landing of the aircraft in Minsk, Belarus, even though they were already closer to Vilnius. In order to protect 171 passengers, the Ryanair Flight FR4978, escorted by an MiG-29, was diverted and landed in Minsk National Airport. After five hours searching for the bomb nothing was found and the plane was free to go. Nonetheless, without both Protasevich and Sapega, who were captured as terrorists. According to the BBC, the situation was just a stunt to imprison him, but it definitely affected other passengers while challenging both human rights law and international law [...]

    Observatory on European Studies _ Cooperación para el desarrollo de la Unión Europea en América Latina: de la “graduación” a la degradación

    Con el nuevo Instrumento para la Vecindad, el Desarrollo y la Cooperación Internacional (IVDCI) y el Marco Financiero Plurianual de 2014 a 2020 (MFP), la Unión Europea (UE) estableció un enfoque “diferenciado” con el que busca “graduar” a aquellos países que hayan mejorado su condición económica, es decir, quienes sean identificados como países de renta media o media-alta. Esto con el objetivo de orientar mejor los recursos y cortar las subvenciones otorgadas por la Ayuda Oficial al Desarrollo (AOD) en donde supuestamente ya no sea necesaria. Sin embargo, esta clasificación ignora la crisis social y económica sobreviniente de los países que han recibido esta etiqueta y los restringe de recibir recursos que puedan ayudar a salir de esta situación. De los 17 países graduados, 11 son latinoamericanos, lo cual expone la intención de la UE de disminuir su presencia económica en la región. En definitiva, este término no solo limita el avance de proyectos comunes entre ambos actores, sino que limita la cooperación para el desarrollo promovida por la UE y relega a América Latina y el Caribe (ALC), lo cual contrasta con el objetivo de la Agenda 2030 de no dejar a nadie atrás [...]

    En la Unión Europea, el Reglamento (CE) núm. 2201/2003 del Consejo, de 27 de noviembre de 2003, relativo a la competencia, el reconocimiento y la ejecución de las resoluciones judiciales en materia matrimonial y de responsabilidad parental, por el que se deroga el Reglamento (CE) núm. 1347/2000, se ocupa de los supuestos de secuestro internacional de menores en varios de sus preceptos. Pero todos los Estados Miembros de la Unión Europea son parte también de dos importantes Convenios internacionales, promovidos por la Conferencia de La Haya de Derecho Internacional Privado, que se ocupan igualmente de esta materia: el Convenio de La Haya de 25 de octubre de 1980 sobre los aspectos civiles de la sustracción internacional de menores; y el Convenio de La Haya de 19 de octubre de 1996 relativo a la competencia, la ley aplicable, el reconocimiento, la ejecución y la cooperación en materia de responsabilidad parental y de medidas de protección de los niños.     This Week began the European Council Simulation, promoted in the scope Jean Monnet Module, in the Law and Policies of the European Union subject, ministered by Dr. Aline Beltrame de Moura in the Universidade Federal de Santa Catarina (UFSC).     Webinar Series - "Experience of Legal Comparison"

    On the 21st, 26th, and 28th of April, three meetings were held as part of the Comparative Private Law of People and Markets course from the University of Milan focusing on the “Experience of Legal Comparison”.

    It was a series of webinars designed to illustrate the practice of comparative law in different professional and institutional contexts:

    On April 21, Ana Flavia Sabi Rizelo talked about her experience with comparison as Para-Legal with the international law firm Leigh Day UK Law Firm, business / human rights protection sector.

    On Monday, April 26, the legal comparison activity carried out by the Italian Constitutional Court Studies Service was illustrated by its Director, Dr. Riccardo Nevola and the Head of the Comparative Law Sector, Prof. Paolo Passaglia.

    Finally, on April 28, Priscila Pereira de Andrade, Legal Officer at Unidroit, shared the experience of the prestigious International Institute for the Unification of Law, Unidroit.

    Observatory on European Studies _ Business and human rights arbitration: a potential procedural remedy for transnational human rights litigation involving European and Latin parties

    In 2015, dams owned by an Australian/British/Brazilian joint venture collapsed in the Brazilian city of Mariana affecting over 240,000 locals. Lawsuits were initiated before courts in Brazil, the United Kingdom and Australia seeking remedy for victims. However, the victim’s attorneys still struggle to overcome jurisdictional barriers and bring the claims before British and Australian courts, while Brazilian prosecutors face challenges to access fair compensation for rights-holders due government interreferences.     I JEAN MONNET NETWORK - BRIDGE SEMINAR "EU-Latin America trade and investment relations"

    The activity is part of the Jean Monnet Network project called “Building Rights and Developing Knowledge between European Union and Latin America - BRIDGE”, which is part of the Federal University of Santa Catarina (Brazil); the Faculty of Law of the University of Lisbon (Portugal); the University of Seville (Spain); the University of Milan (Italy); the National Autonomous University (Mexico); the University of Buenos Aires (Argentina) and the University of Rosario (Colombia).

    I JEAN MONNET NETWORK - BRIDGE SEMINAR "EU-Latin America trade and investment relations"

    On March 15th, 2021, at 5 pm (PT time - GMT 0), the Faculty of Law of the University of Lisbon will hold a conference on "EU-Latin America trade and investment relations".

    Among the participants are the Minister of State and Foreign Affairs of Portugal, Augusto Santos Silva, the President of the European Parliament's Delegation for relations with Brazil; the EU Ambassador to Brazil and the Undersecretary of the Secretariat for Foreign Affairs of Mexico.

    The conference is part of the Jean Monnet Network project called “Building Rights and Developing Knowledge between European Union and Latin America - BRIDGE”, which is part of the Federal University of Santa Catarina (Brazil); the Faculty of Law of the University of Lisbon; the University of Seville (Spain); the University of Milan (Italy); the National Autonomous University (Mexico); the University of Buenos Aires (Argentina) and the University of Rosario (Colombia).

    The first issue of the Latin American Journal of European Studies is now open for submissions!

    The Latin American Journal of European Studies aims to disseminate innovative scientific research focusing on the editorial lines themes “European Union Law and Policies” and “European Union International Relations with Third Countries and Latin America” and is open to new submissions.

    The first issue of the Journal will have a thematic dossier on “EU-Latin America trade and investment relations” organized by Nuno Cunha Rodrigues from the University of Lisbon (Portugal).

    Observatory on European Studies _ The Association Agreement between the European Union and Mercosur and the environment: political and legal obstacles on the way forward

    The negotiations on the Association Agreement between the European Union (EU) and Mercosur (hereinafter, the ‘Agreement’) encompass three pillars: political dialogue, cooperation and trade. In June 2019, the two blocs reached an ‘agreement in principle’ on the trade pillar, after 20 years of negotiations. In June 2020, negotiations on the political and cooperation chapter were concluded. Despite this, the conclusion of the Agreement seems far from completion, since the text still needs to be finalised, signed and, finally, ratified in order to enter into force. As it is a ‘mixed’ agreement (its content falls within competences shared between the Member States and the European Union, and therefore is concluded between EU countries and the bloc as a whole), it must be ratified not only by the European Parliament, but also by each of the countries of the EU. It is a process that involves political and legal hurdles in domestic, European and international law [...]

    OBSERVATORY ON EUROPEAN STUDIES__Jurisdição internacional e apostas on-line: showdown do Tribunal de Justiça da União Europeia

    No dia 10 de dezembro de 2020 a Sexta Secção do tribunal de Justiça da União Europeia proferiu um interessante acórdão em tema de comércio eletrônico, no que concerne a competência jurisdicional em caso de contrato on-line celebrado por consumidor, segundo o Regulamento (CE) no. 44/2001 (Bruxelas I). Especificamente, o Tribunal traz elementos da própria jurisprudência para consolidar o conceito de consumidor e esclarecer situações que podem gerar dúvidas: afirma a condição de consumidor não obstante que a atividade (jogo de azar, no específico jogo de pôquer on-line) fosse desempenhada durante muitas horas por dia, que o usuário possuísse amplos conhecimentos a respeito e que tivesse obtido, com o tempo, ganhos significativos através da mesma.
